RESOLVED:

1. To adopt the recommendations contained in Minute 96 of the meeting of the Cabinet held on 21 February 2008 with regard to the Capital Programme and Housing Investment Programme 2008/09.

2. That the General Fund Revenue Budget and Service Plan 2008/09, along with the revenue growth proposals for 2008/09, referred to in Minute 98 of the meeting of the Cabinet held on 21 February 2008 be approved.

3. That the sum of £1,016,803 be taken from General Fund Balances in 2008/09 to support General Fund revenue expenditure in that year.

4. That it be noted that the Finance Portfolio Holder determined on 10 January 2008, the following amounts for the year 2008/09 in accordance with regulations made under section 33(5) of the Local Government Finance Act 1992.

(a) 37,705.84 being the amount calculated by the Council, in accordance with regulation 3 of the Local Authorities (Calculation of Council Tax Base) Regulations 1992, as its council tax base for the year.

being the amounts calculated by the Council, in accordance with regulation 6 of the Regulations, as the amounts of its council tax base for the year for dwellings in those parts of its area to which one or more special items relate.

5. That the following amounts be now calculated by the Council for the year 2008/09 in accordance with sections 32 to 36 of the Local Government Finance Act 1992:

(a) £60,332,250 being the aggregate of the amounts which the Council estimates for the items set out in section 32(2)(a) to (e) of the Act.

(b) £45,917,003 being the aggregate of the amounts which the Council estimates for the items set out in section 32(3)(a) to (c) of the Act

(c) £14,415,247 being the amount by which the aggregate at 5(a) above exceeds the aggregate at 5(b) above, calculated by the Council, in accordance with section 32(4) of the Act, as its budget requirement for the year

(d) £8,875,692 being the aggregate of the sums which the Council estimates will be payable for the year into its general fund in respect of redistributed non-domestic rates, revenue support grant and collection fund surpluses & deficits.

(e) £146.92 being the amount at 5(c) above less the amount at 5(d) above, all divided by the amount at 4(a) above, calculated by the Council, in accordance with section 33(1) of the Act, as the basic amount of its council tax for the year

(f) £292,150 being the aggregate amount of all special items referred to in section 34(1) of the Act

(g) £139.17 being the amount at 5(e) above less the result given by dividing the amount at 5(f) above by the amount at 4(a) above, calculated by the Council, in accordance with section 34(2) of the Act, as the basic amount of its council tax for the year for dwellings in those parts of its area to which no special item relates

being the amounts given by multiplying the amounts at 5(g) and 5(h) above by the number which, in the proportion set out in section 5(1) of the Act, is applicable to dwellings listed in a particular valuation band divided by the number which in that proportion is applicable to dwellings listed in valuation band D, calculated by the Council, in accordance with section 36(1) of the Act, as the amounts to be taken into account for the year in respect of categories of dwellings listed in different valuation bands.

6. That it be noted that for the year 2008/09, Nottinghamshire County Council, the Nottinghamshire Police Authority and the Combined Fire Authority have stated the following amounts in precepts issued to the Council, in accordance with section 40 of the Local Government Finance Act 1992, for each of the categories of dwellings shown below:

99Consideration was given to the recommendations of the Cabinet (minute numbers 96 and 98) dated 21 February 2008, together with the report of the Leader of the Council on Council Tax levels for 2008/09.

A proposition was moved by Councillor R.F Spencer and seconded by Councillor Golland in the following terms:-

"1. To adopt the recommendations contained in Minute 96 of the meeting of the Cabinet held on 21 February 2008 with regard to the Capital Programme and Housing Investment Programme 2008/09.

An amendment was moved by Councillor Pulk and seconded by Councillor W.J Clarke "That the Council has the following objections and proposals to the estimates submitted by the Cabinet and it requires the Cabinet to reconsider those estimates in the light of these objections and proposals and report back to the Council within five working days after the day of this meeting. The Council moves that full consideration should be given to the following provisions proposals and objections: -

1. The provision of a weekly bin collection for 12 weeks in the summer is objected to and that this be removed from the estimates.
2. That the Council sets an increase of 3.25% equating to an increase of £4.39 per annum on a Band D property from £135.12 to £139.51.
3. That a summary of the Council's Medium Term Financial Plan is included based on an annual increase of 3.25% (as shown in schedule 1)
4. That working balances be 6.5% of total projected expenditure.
5. Provision for an additional six bi-weekly summer garden waste collections (using 2 sacks per household) free across the Borough be added to the budget.
6. Provision of sacks for summer waste collection.
7. Provision of carbon filters for grey bins free on request.
8. Provision of a 24-hour call out response for noise nuisance free to users.
9. Provision of a neighbourhood mediation service free to users.
10. Provision of composters free on request (to a maximum of 2000 across the Borough)
11. Provision for an increase in CCTV monitoring for 24 hours 7days per week.
12. Provision for the retention of support for PCSOs at the current level and carrying out consultation on future retention."

The Mayor put the amendment to the meeting and declared the same defeated.

A further amendment was moved by Councillor Gillam and seconded by Councillor Wright "That the Council has the following objections and proposals to the estimates submitted by the Cabinet and it requires the Cabinet to reconsider those estimates in the light of these objections and proposals and report back to the Council within five working days after the day of this meeting. The Council moves that full consideration should be given to the following provisions proposals and objections: -

1. Provision of £100,000 in the capital programme to provide a scheme or schemes to generate energy or reduce the consumption of energy at the Civic Centre or any other buildings owned by the Borough Council. The cost to be met from under spends in other programmed items within the capital budgets
2. Provision of the summer bin collection is objected to and this be removed from the estimates saving £160,000
3. Provision of a £132,000 revenue budget to reduce Anti Social Behaviour in the Borough
4. Provision of a free collection service for fridges and freezers from households within the Borough, costing £14,000
5. £14,000 to be added to the graffiti removal/fly-tipping collection budget."

The Mayor put the further amendment to the meeting and declared the same defeated.
