To seek approval for Gedling Borough Council’s response to the consultation on the Local Cycling and Walking Infrastructure Plan for the D2N2 area.

That the Portfolio Holder approves the proposed response attached as Appendix A to the D2N2 consultation on the Local Cycling and Walking Infrastructure Plan.

To approve a 3 week consultation period to ask local residents, businesses and agencies their opinions on a Public Spaces Protection Order.

The purpose of this report is:
To seek approval to adopt the Council’s guidance at Appendix 2 to this report, for determining eligibility for 2023 supporting small business relief.
To delegate to the Director responsible for Revenues Services, the authority to determine eligibility for 2023 supporting small business relief under section 47 of the Local Government Finance Act 1988 in relation to non-domestic premises in the Borough.

THAT:
The Council’s guidance for determining eligibility for 2023 supporting small business relief, held at Appendix 2 to this report, is adopted;
The determination of eligibility for 2023 supporting small business relief is delegated to the Director responsible for Revenues Services.

To seek approval to use the Government’s guidance held at a permalink on the Government’s website, gov.uk, for determining an application for discretionary retail, hospitality and leisure relief.
To delegate to the Director responsible for Revenues Services, the authority to determine applications for discretionary relief under section 47 of the Local Government Finance Act 1988 in relation to non-domestic retail, leisure and hospitality premises in the Borough.

THAT:
the Government’s guidance for determining an application for discretionary retail, hospitality and leisure relief, held at the permalink on the gov.uk website, is approved as if it were the Council’s guidance;
the determination of applications for discretionary retail hospitality and leisure relief is delegated to the Director responsible for Revenues Services.

To seek approval to transfer Section 106 Developer Contributions, which have been collected by Gedling Borough Council, to the Local Parish Councils to be spent on infrastructure projects in accordance with the terms and obligations set out in the relevant Section 106 Agreements as detailed in the attached report.

1) To seek approval to transfer the open space development contributions received under S106 developer agreements to Burton Joyce Parish Council and Calverton Parish Council for spend on capital projects which meet the requirements of the developer agreements.
2) To establish by virement the capital programme budgets for the delivery of open space development projects by the Parish Councils, to be funded by S106 developer contributions.

To approve:

(a) the Council’s scheme of discretionary discounts to deliver additional financial support in 2023/24 to council tax payers in the Borough of Gedling as detailed in the report at paragraph 2.1 and devised in accordance with the Council Tax Support Fund guidance issued by the Government;

(b) The establishment, by virement, of a Council Tax Support Fund budget of £172,600 to be funded by Government Grant;

(c) The delegation to the Director responsible for Welfare Support Services the authority to determine applications for discretionary reduction in council tax under section 13A(1)(c) of the Local Government Finance Act 1992 in relation to the additional financial support for council taxpayers 2023/24 scheme in the Borough of Gedling in line with the scheme outlined in this report;

The purpose of this report is:
To seek approval to implement, in accordance with the latest Government guidance, the Energy Bills Support Scheme Alternative Fund.
To adopt the Government’s guidance (and any future iterations of the same guidance), at Appendix 1 to this report, for determining eligibility to the Energy Bills Support Scheme Alternative Fund payments.
To delegate, to the Director of Corporate Resources, the authority to determine eligibility, in accordance with the Government’s guidance.

THAT:
1)the Energy Bills Support Scheme Alternative Fund detailed at Appendix 1 to this report is implemented in accordance with the latest Government guidance;
2)the Government’s Energy Bills Support Scheme Alternative Fund guidance (and future iterations of the same guidance), detailed in Appendix 1 to this report, is adopted;
3)a delegation is provided to the Director of Corporate Resources, for the determination of eligibility to the Energy Bills Support Scheme Alternative Fund, in accordance with the Government’s guidance.

The purpose of this report is:
To seek approval to implement, in accordance with the latest Government guidance, the Alternative Fuel Payment Alternative Fund.
To adopt the Government’s guidance (and any future iterations of the same guidance), at Appendix 1 to this report, for determining eligibility to the Alternative Fuel Payment Alternative Fund payments.
To delegate, to the Director of Corporate Resources, the authority to determine eligibility, in accordance with the Government’s guidance.

THAT:
1)the Alternative Fuel Payment Alternative Fund detailed at Appendix 1 to this report is implemented in accordance with the latest Government guidance;
2)the Government’s Alternative Fuel Payment Alternative Fund guidance (and future iterations of the same guidance), detailed in Appendix 1 to this report, is adopted;
3)a delegation is provided to the Director of Corporate Resources, for the determination of eligibility to the Alternative Fuel Payment Alternative Fund, in accordance with the Government’s guidance.

To gain portfolio holder endorsement of Gedling Borough Council’s proposed response contained in Appendix 1 to the Government consultation on changes to the National Planning Policy Framework (NPPF). The consultation response is required to be submitted by 2nd March 2023.

THAT:
1)The Portfolio Holder approves the proposed response to the consultation on proposed changes to the NPPF – as set out under the relevant questions reproduced in Appendix 1.
