RESOLVED:

 

That the minutes of the above meeting, having been circulated, be approved as a correct record.

Declaration of Interests.

Exclusion of the Press and Public.

To move that under Section 100(A)(4) of the Local Government Act 1972 the public and press be excluded from the meeting during consideration of the ensuing report on the grounds that the report involves the likely disclosure of exempt information as defined in Paragraph 7 of Part 1 of Schedule 12A of the Local Government Act 1972.

RESOLVED:

 

That, the Members being satisfied that the public interest in maintaining the exemption outweighs the public interest in disclosing the information that under Section 100(A)(4) of the Local Government Act 1972, the public and press be excluded from the meeting during the consideration of the ensuing reports on the grounds that the report involves the likely disclosure of exempt information as defined in Paragraph 7 of Part 1 of Schedule 12A of the Local Government Act 1972.

Application for a Carriage/Private Hire Drivers Licence - IM

Report of Corporate Director - David Wakelin

Minutes:

The Committee considered a report from Corporate Director, David Wakelin, regarding an application for a Joint Hackney Carriage/Private Hire Driver's Licence from IM.

 

IM attended the meeting and addressed the Committee.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that no exceptional circumstances existed which warranted departure from this policy.

 

RESOLVED:

 

To approve IM’s application for a Hackney Carriage/Private Hire Driver's Licence.

 

7.

Application for a joint Hackney Carriage/Private Hire Drivers Licence - MS

Report of Corporate Director - David Wakelin

Minutes:

The Committee considered a report from Corporate Director, David Wakelin, regarding an application for a Joint Hackney Carriage/Private Hire Driver's Licence from MS.

 

MS attended the meeting, accompanied by his wife who addressed the Committee on his behalf.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that no exceptional circumstances existed which warranted departure from this policy.

 

RESOLVED:

 

To refuse MS’s application for a Hackney Carriage/Private Hire Driver's Licence on the grounds that he is not a fit and proper person.

 

MS was advised of his right to appeal against the decision of the Committee.

 

8.

Change of circumstances and renewal of joint Hackney Carriage/Private Hire Drivers Licence - RM

Report of Corporate Director - David Wakelin

Minutes:

The Committee considered a report from Corporate Director, David Wakelin, regarding a change of circumstance and application for the renewal of a Joint Hackney Carriage/Private Hire Driver's Licence from RM.

 

RM attended the meeting and addressed the Committee.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that no exceptional circumstances existed which warranted departure from this policy.

 

RESOLVED:

 

To revoke RM’s Hackney Carriage/Private Hire Driver's License with immediate effect, on the grounds that he is no longer considered a fit and proper person.

 

Due to the revocation of RM’s license, the application for renewal of the license could not be considered by Committee.

 

RM was advised of his right to appeal against the decision of the Committee.

 

9.

Change of circumstances and renewal of joint Hackney Carriage/Private Hire Drivers Licence - DM

Report of Corporate Director - David Wakelin

Minutes:

The Committee considered a report from Corporate Director, David Wakelin, regarding a change of circumstance and renewal of a Joint Hackney Carriage/Private Hire Driver's Licence from DM.

 

DM attended the meeting and addressed the Committee.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that exceptional circumstances existed which warranted departure from this policy.

 

RESOLVED:

 

To not revoke DM’s license and to approve the application for renewal of his Hackney Carriage/Private Hire Driver's Licence, with a warning as to the necessary consequences of any further convictions or appearances before Committee.

10.

Change of circumstances of Hackney Carriage/Private Hire Drivers Licence - MK

Report of Corporate Director - David Wakelin

Minutes:

The Committee considered a report from Corporate Director, David Wakelin, regarding a change of circumstance of a Joint Hackney Carriage/Private Hire Driver's Licence from MK.

 

MK attended the meeting, represented by his solicitor who addressed the Committee.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that no exceptional circumstances existed which warranted departure from this policy.

 

RESOLVED:

 

To revoke MK’s Hackney Carriage/Private Hire Driver's License without immediate effect, on the grounds that he is no longer considered a fit and proper person and to give MK 21 days to surrender his licence.

 

MK was advised of his right to appeal against the decision of the Committee.

Application for a joint Hackney Carriage/Private Hire Drivers Licence - MA

The Committee considered a report from Corporate Director, David Wakelin, regarding an application for a Joint Hackney Carriage/Private Hire Driver's Licence from MA.

 

MA attended the meeting, accompanied by his wife, and addressed the Committee.

 

In making its decision, the Committee applied the Council's approved Policy and Guidelines. On the basis of what it heard, the Committee was satisfied on balance that no exceptional circumstances existed which warranted departure from this policy.

To approve MA’s application for a Hackney Carriage/Private Hire Driver's Licence.
