Legal Representation in the Magistrates’ Court

Reference: D810

Decision Maker: Leader of the Council

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Purpose:

To seek authorisation for an employee, to appear on behalf of the Council in proceedings before the Magistrates’ Court

Decision:

Authorises Craig Allcock to appear on the Council’s behalf at the direction of the Director of Organisational Development and Democratic Services in proceedings at the Magistrates’ Court under section 223 of the Local Government Act 1972.

Reasons for the decision:

The experience of appearing for the Council at the Magistrates’ Court will assist with employee's professional development and will free up time and resources of more senior staff who currently act for the Council in such proceedings.

Alternative options considered:

Not to authorise the employee to represent the Council at the Magistrates’ Court. This would mean continued strains on senior members of the legal team and would not necessarily be an effective or efficient use of resources. It would also deprive the employee of the opportunity to develop their advocacy skills and broaden their legal expertise.
