Purpose:

To seek approval to adopt revised selective licensing conditions following a recent Court of Appeal case.
To seek approval to formally set the other fees associated with the selective licensing scheme which were included in the proposal to declare a selective licensing designation and approved to go out to public consultation but were not formally set in the 8th March 2018 report to Cabinet .

Decision:

To adopt revised selective licensing conditions to incorporate the decision of the Hydburn case and the provisions of the Housing Act 2004 and associated regulations.
To formally set the other fees associated with the scheme as per paragraph 2.2 of this report.

Reasons for the decision:

To improve health and wellbeing and to ensure the selective licensing scheme is self-financing and compliant with relevant legal provisions.

Alternative options considered:

To retain the conditions adopted by Cabinet which could be subject to legal challenge.
To not formally set the proposed list of other fees associated with the scheme which would lead to additional council resources being utilised and the scheme would not be self-financing.
