Purpose:

An adverse insurance report revealed defects to an electric two post vehicle lift at a commercial garage. The defects to the lift presented an imminent risk of serious personal injury if the lift fell.

Decision:

As the remedial works had not been carried out on the lift, following consultation with the insurance company's competent person a Health and Safety at Work etc Act 1974 section 22 Prohibition Notice was served on the person in control of the business prohibting the use of the vehicle lift.

Reasons for the decision:

Regard was had to the Department's health and safety policy, HSE guidance and the opinion of the specialist inspector who examined the lift for the purposes of the Lifting Operations and Lifting Equipment Regulations 1998.

Alternative options considered:

As the business had not taken sufficient steps to ensure that the lift could not used, no other action was considered.
